This Privacy and Personal Data Processing Policy (hereinafter — the Policy) governs the procedure for the collection, processing, storage and protection of personal and other data of users of the eaudio.shop online store, owned by EmotionsAudio LLP (ТОО «EmotionsAudio»), BIN 260440039943, registered address: Astana, 33/1 Bukhar Zhyrau St., unit 19 (hereinafter — the Operator).

By transferring personal data to the Operator through filling it in on the website, the User confirms their consent to its processing on the terms of this Policy. If the User does not agree with the terms of the Policy, they must stop using the website.

1. TERMS

1.1. Website — the online store located on the Internet at https://eaudio.shop. All exclusive rights to the Website and its individual elements (including software and design) belong to the Operator.

1.2. User — an individual using the Website.

1.3. Legislation — the applicable legislation of the Republic of Kazakhstan, including the Law of the Republic of Kazakhstan No. 94-V of 21.05.2013 “On Personal Data and Its Protection”.

1.4. Personal data — information relating to a User who is identified or identifiable on its basis, which the User provides independently when placing an order, registering or in the course of using the Website.

1.5. Processing of personal data — actions aimed at the accumulation, storage, modification, supplementation, use, dissemination, depersonalisation, blocking and destruction of personal data.

2. WHAT DATA WE COLLECT

2.1. When an order is placed and upon registration, the Operator collects:

  • surname and first name;
  • telephone number;
  • e-mail address;
  • delivery address;
  • order history.

2.2. The following is collected automatically when the Website is used: IP address, information about the browser and device, cookies, data about visited pages (depersonalised web analytics).

2.3. The Operator does not collect or store: data from identity documents, the IIN, or bank card details. Payment is made through secure payment services — card data is not transferred to the Operator and is not stored on its servers.

2.4. The User is prohibited from providing the personal data of third parties, except where they represent the interests of such persons and have documentary confirmation of the relevant authority.

3. PURPOSES OF PROCESSING

3.1. Personal data is processed solely for the following purposes:

  • placing, processing and delivering orders;
  • communicating with the User on matters relating to the order;
  • maintaining the personal account and order history;
  • informing about the order status;
  • improving the operation of the Website on the basis of depersonalised analytics;
  • sending informational and advertising materials — only where the User has given separate consent, which may be withdrawn at any time.

3.2. The collection and processing of personal data are limited to achieving the specific, predetermined and lawful purposes set out in clause 3.1. The term of the consent to processing does not exceed the period necessary to achieve the purposes of collection and processing.

4. PROCESSING PROCEDURE AND TRANSFER TO THIRD PARTIES

4.1. The Operator processes personal data in accordance with the Legislation, using means of automation.

4.2. The confidentiality of the User’s personal data is maintained, except where the data is publicly available.

4.3. The Operator transfers personal data to third parties only to the extent necessary to fulfil the order: to delivery services (CDEK, Kazpost, etc.) — surname, first name, telephone, delivery address; to payment services — the data necessary to carry out the payment.

4.4. The Operator has the right to transfer personal data without the User’s consent: to state authorities upon their reasoned request; in other cases expressly provided for by the Legislation.

4.5. The Operator does not sell or transfer personal data to third parties for marketing purposes.

4.6. Personal data may be stored on servers located outside the Republic of Kazakhstan, provided that a level of protection no lower than that required by the Legislation is ensured.

5. STORAGE AND PROTECTION

5.1. The Operator takes the necessary and sufficient organisational and technical measures to protect personal data from unlawful or accidental access, destruction, modification, blocking, copying and dissemination: connection encryption (SSL/TLS), access rights segregation, backups.

5.2. Personal data is stored for the period necessary to achieve the purposes of processing, or until the User withdraws consent, unless otherwise provided by the Legislation.

6. RIGHTS OF THE USER

6.1. The User has the right to:

  • receive information about which of their personal data is processed by the Operator;
  • demand the modification or supplementation of their personal data;
  • demand the blocking or destruction of personal data processed in breach of the Legislation;
  • withdraw consent to the processing of personal data;
  • unsubscribe from the mailing list at any time (via the link in the e-mail or upon request).

6.2. To exercise these rights, the User sends a request to the e-mail EmotionsAudio@yandex.kz or in writing to the Operator’s registered address. Requests are considered within the time limits established by the Legislation.

6.3. Upon withdrawal of consent, the Operator ceases the processing of personal data and destroys it, with the exception of data whose further processing is mandatory by virtue of the Legislation (for example, information about completed orders within the retention periods for accounting documentation).

7. COOKIES

7.1. The Website uses cookies for the correct operation of the cart, authorisation and web analytics. By continuing to use the Website, the User agrees to the use of cookies.

7.2. The User may disable cookies in their browser settings; however, some Website functions (cart, personal account) may become unavailable.

8. USERS FROM THE RUSSIAN FEDERATION

8.1. By placing an order on the Website, Users located in the territory of the Russian Federation consent to the processing of their personal data by the Operator, located in the territory of the Republic of Kazakhstan, to the extent and for the purposes set out in this Policy.

9. FINAL PROVISIONS

9.1. This Policy and the relations between the User and the Operator are governed by the law of the Republic of Kazakhstan.

9.2. Disputes are resolved in compliance with the mandatory pre-trial procedure: the User sends the Operator a written claim, the response period being 10 business days. If settlement is not possible, the dispute is referred to the court at the place of the Operator’s registration, unless a different jurisdiction is established by the mandatory provisions of the legislation of the User’s place of residence.

9.3. The invalidity of individual provisions of the Policy does not affect the validity of the remaining provisions.

9.4. The Operator has the right to amend the Policy unilaterally. Amendments come into force from the moment the new revision is published on the Website. The User is advised to review the current revision periodically.
